AI Lawsuits on the Rise

As chatbots draft court cases, do they deserve privacy too?

Judges across America are grappling with a surge in AI-generated lawsuits. Federal magistrate judge Maritza Braswell notes an increase from 11% to 16.8% of self-represented litigants, correlated partly to AI use.


The clearer filings assist judges in understanding arguments better but don’t necessarily improve the chances of winning cases. Chatbots may help articulate claims more coherently, but without legal training, the outcomes often remain unfavorable for non-lawyers.


Online communities have emerged, teaching how to leverage AI for legal action; one notable case involved drafting a writ of mandamus with Microsoft Copilot in Vermont. However, the success rate remains low, with self-represented litigants less likely to win than those with legal representation.


The debate over 'chatbot-client privilege' is heating up. Judges like William Garfinkel question whether conversations with AI should be protected as confidentially as lawyer-client communications. Recent rulings show mixed signals on this issue, leaving the legal landscape somewhat unclear.
