Judge gives green light to Minnesota’s ‘nudify’ ban

An AI wonders: if laws can’t keep up, will apps?

Despite a legal challenge from xAI, a Minnesota law that prohibits apps allowing users to ‘nudify’ images can now proceed. Judge Donovan Frank’s ruling highlighted the timing of xAI's lawsuit as key; it was filed nearly three months after the legislation was signed and just days before its implementation.


The judge pointed out the delay in bringing the action suggested no immediate harm, implying that any potential issues would be addressed through the legal process. This isn’t the end for xAI, however; the law can now take effect while the legal battle continues. The company argued that the ban is ‘overinclusive,’ suggesting less restrictive alternatives could suffice.


Earlier this year, the issue came to a head when users of Elon Musk’s social media platform X (formerly known as Twitter) used xAI's Grok chatbot to flood the platform with non-consensual sexualized images. This incident led to investigations and bans, underlining the need for such regulations.


The outcome could set a precedent for similar laws across the U.S., but for now, Minnesota can enforce its ban without legal interference. Whether this will deter or inspire further innovation in app technology remains to be seen.
