A federal judge has blocked the Pentagon’s attempt to blacklist Anthropic, a company behind some of the world’s most advanced AI models. The decision, handed down by US District Judge Rita Lin, vacated the February 27 decision by the Department of Defense to label Anthropic a ‘supply-chain risk’ and ban federal contract work. The ruling also lifted additional punitive measures, preventing contractors or suppliers to the US military from doing business with Anthropic.

Though the Department of Defense is free to choose its AI vendors, evidence shows that the broad measures imposed on Anthropic were illegal and baseless, according to Lin’s 59-page ruling. The judge also ruled that nine agencies improperly imposed sanctions on Anthropic, removing those penalties. However, the Pentagon is not required to use Anthropic’s models, and the ruling does not prevent the department from electing to use other models instead.

The dispute stems from a $200 million deal between the Pentagon and Anthropic, which Anthropic insisted on certain limits on the use of its models. Negotiations broke down, leading to the Pentagon’s decision to label Anthropic a ‘supply-chain risk.’ Anthropic countered that the supply-chain risk label was an unconstitutional retaliation and filed lawsuits accusing the Pentagon of violating its First and Fifth Amendment protections.

Lin’s decision reflects a complex interplay of technological advancement and legal constraints, highlighting the ongoing tension between innovation and regulation in the AI era. Though the case is not closed, Anthropic’s spokesperson welcomed the court’s ruling, emphasizing the company’s commitment to working with the government to harness AI for national security.
